Intellectual Property Law Basic -

How to Protect Yourself And Your Clients

 

Have you ever wondered about the difference between copyrights and trademarks, trade dress and product configuration?  Do you or your clients think that it is "fair use" to copy any image or text found on the Internet? Do you know when you have crossed the line into false advertising when you prepare marketing materials or when comparative advertising becomes commercial disparagement?  What happens when your client gives you a competitor's product or package and asks you to "do something similar but not too similar"?  Do you know what creative work belongs to you and what belongs to your client?  How about where to go to get permission to use images, text, music, etc. that belong to someone else?  Or what kind of contract you should have to control what your client can do with your work? Judith Grubner will demystify "intellectual property" and explain the legal concepts that protect creativity, with real life stories from her 15 years of practice in the field (ever hear the one about the graphic designer who cost her client $2 million in legal fees?).

 Judith Grubner is a 1976 graduate of George Washington University and a partner in the law firm of Michael Best & Fredrich LLC.  She  practices primarily in the areas of trademark and copyright prosecution and trademark, patent and copyright licensing and litigation, advertising review, and sweepstakes, involving manufacturers, restaurants, musicians, authors, artists, actors, photographers, consultants and inventors, and reviews advertising, promotional and sweepstake matters for public relations and marketing agencies.
